Terms and Conditions

These Terms & Conditions (“Terms”) govern your use of jasminpaul.design (the “Site”) and any design‑related consultations, proposals, files, or services (“Services”) provided by Jasmin Paul (“I,” “me,” or “my”). By accessing the Site, scheduling a call, requesting a proposal, or otherwise engaging my Services, you agree to be bound by these Terms. If you do not accept the Terms in full, please discontinue use of the Site and Services immediately.

The content published on the Site—including text, images, case studies, graphics, and layouts—is protected by international copyright, trademark, and other intellectual‑property laws. You may view this material solely to evaluate my capabilities and may not reproduce, distribute, or create derivative works without my prior written consent. Client projects displayed in the portfolio remain the intellectual property of those clients and appear on the Site under license or fair‑use principles.

When you request Services, I will email a written proposal outlining scope, deliverables, timeline, and fees. Engagement begins only after you accept the proposal in writing and pay the stated deposit (typically 30 percent of the project fee unless otherwise agreed). The remaining balance is due upon delivery of final assets. Late payments accrue interest at 1.5 percent per month—or the maximum amount allowed by law—until paid in full. Ownership of final, approved deliverables transfers to you once all invoices have been settled; all preliminary drafts, unused concepts, or working files remain my property unless expressly assigned.

I am committed to meeting agreed timelines, but schedules may shift due to client feedback cycles, additional requirements, or unforeseen circumstances such as illness, natural disaster, or internet outages. If delays occur, I will communicate promptly and propose a reasonable revised timeline. Either party may terminate an active project with seven calendar days’ written notice. In the event of termination, you will be responsible for payment of work completed up to the termination date, and I will supply any work in progress after payment is received.

You agree to provide timely feedback, content, and approvals necessary for the Project’s success. Failure to do so may affect the schedule and could incur additional costs. You also warrant that any materials you supply—such as logos, images, or copy—do not infringe third‑party rights. You agree to indemnify and hold me harmless from any claims, damages, or legal fees arising from materials you provide.

The Site and Services are offered “as is” without warranties of any kind, expressed or implied, including fitness for a particular purpose, accuracy, or non‑infringement. To the maximum extent permitted by law, I shall not be liable for any indirect, incidental, or consequential damages arising out of your use of (or inability to use) the Site or Services—even if advised of the possibility of such damages. My total cumulative liability under these Terms shall not exceed the fees you actually paid for the specific Service that gave rise to the claim.

Your submission of personal information through the Site is governed by my separate Privacy Policy, which explains how data is collected, used, and protected. By continuing to use the Site, you consent to the processing of your data as outlined in that policy.

I reserve the right to update or modify these Terms at any time. Material changes will be posted on this page with a new “Last updated” date. Your continued use of the Site or Services after such changes signifies acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of the Republic of Poland, without regard to conflict‑of‑law provisions. The competent courts of Warsaw, Poland, shall have exclusive jurisdiction over any dispute arising from these Terms or your use of the Site or Services. If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
